As a user of this website (referred to as you/your) you agree that any use of this site, including any transactions you make, are subject to our terms and conditions stated below. General Terms 1.1 We reserve the right to change the terms and conditions at any time. The date at the top of the page shows when the latest terms and conditions are effective from and your use of this site signifies your acceptance of them. 1.2 If you are not a consumer, you confirm that you have the authority to bind any business on whose behalf you use this site 2. Cookies You must have your cookies enabled to add items to your Basket and allow your order to be processed successfully. You will also be able to register your details with our website. Cookies are pieces of information that your computer stores in the hard drive. We can also use them to: identify you as you use our website, provide site and purchasing information to enable us to improve our website and the products/services we offer. Your identity cannot be traced to you by any part of the cookie. 3. Delivery 3.1 Products available for purchase on this website are for delivery to addresses in theUnited Kingdom(including outer British Isles) andNorthern Ireland. FREE UK DELIVERY applies to all orders for delivery to Mainland UK Post Codes. Occasionally, due to the nature of the product, a charge will apply for delivery of the item. This will be shown with the product details and we would recommend you email us before placing the order so we can contact you with details of the delivery charges 3.2 Delivery to addresses outside theUKare available and will be charged at cost plus labour. We recommend you email us with your requirements before placing an order and we will advise of the delivery charge, which will be taken as a separate payment. Overseas delivery charges are estimated and we reserve the right to increase charges where necessary. 3.3 Allow 3 to 7 days for delivery of goods from stock. Delivery estimates will be advised for goods which we have to order for you. 3.4 Delivery estimates are given based on information from our suppliers. Every effort will be made to deliver the goods within this estimate, however, delays can occur. We are not, therefore, under liability for delay in delivering the goods within these estimates and will keep you advised if there is a problem. 3.5 The risk of damage to, or loss of, the product becomes your responsibility on the date the goods are delivered to you. 4. Payment 4.1 Supply of goods is subject to availability. If we are unable to supply the goods we will contact you as soon as possible and a full refund on goods already paid for will be given. 4.2 Prices are as displayed on this website at the time of ordering. Every effort is made to ensure all the prices are correct but if we find an error we will contact you as soon as possible. We will then give you the option to confirm your order at the correct price, or cancel it and receive a full refund on goods already paid for.If we cannot contact you we will cancel the order and refund any monies paid. 4.3 Your title to the products ordered from our website commences upon their delivery, provided full payment has been processed and received. 4.4 All prices include VAT (where applicable) at the current rates. VAT will be deducted from all overseas orders (outside the EEC) and will be shown as a deduction from the delivery charges quoted by email before ordering. 5. Intellectual Property 5.1 You acknowledge and agree that all copyright, trademarks and all other intellectual property rights, in all materials and/or content made available as part of your use of this website shall remain at all times vested in us or our licensors (as appropriate). You are permitted to use this material only as expressly authorised by us or our licensors (as appropriate). Liability and Indemnity 6.1 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or exclude under applicable law. 6.2 Subject to Section 6.1 above, we will use reasonable endeavours to verify the accuracy of any information on the site but make no representation or warranty of any kind (whether express or implied, statutory or otherwise) regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server from which it is made available are free from viruses or bugs or represents the full functionality, accuracy, reliability of the website: Lambs will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and we accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site. 6.3 Subject to section 6.1 above, other than as expressly provided these terms and conditions with respect to specific products and except for the exclusive remedies set out at Section 5 above, any indemnities, warranties, terms and conditions (whether express or implied) are hereby excluded to the fullest extent permitted under applicable law. 6.4 Subject to Section 6.1 above, we will not be liable whether in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise arising out of or in connection with these terms and conditions for any: >economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings): or >loss of goodwill or reputation: or >special or indirect losses suffered or >incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions. 6.5 Notwithstanding the above, subject to Section 6.1, our aggregate liability (whether in contract, tort or otherwise) for loss or damage shall in any event be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same cause. 6.6 This clause 6 does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights. 6.7 All reasonable precautions to keep the details of your order and payment secure will be taken but, unless we are negligent, we cannot be held responsible for any loss caused as a result of unauthorised access to information you provide us with. 7. Miscellaneous Provisions 7.1 The contract between us shall be governed by the laws ofEnglandand any dispute between us will be resolved exclusively in the courts ofEngland. English is the only language offered for the conclusion of the contract. 7.2 Google Checkout processes all debit, credit and charge card payments for customers and will retain a handling fee from the transaction value. The remaining amount will be paid to Lambs for the goods and services supplied. The total amount payable by all customers, regardless of the means of payment, will be the same. Lambs will incur the cost of the handling fee on behalf of the customer. 7.3 Lambs will be under no liability for any delay, or failure, to deliver products purchased on this website, or perform any obligation as specified in these terms and conditions if the same is wholly or partly caused, whether directly or indirectly, by circumstances beyond its reasonable control. 8. Returns and Cancellations 8.1 You may cancel your order at any time before despatch. Also, under the United Kingdom Distance Selling Regulations, you have the right to cancel the contract for any of the items purchased (with the exception of earrings and personalised goods, unless supplied incorrectly) within 7 working days, starting on the day after the day on which the item was delivered. 8.2 To cancel the contract, please email us immediately with details of the order and why it is being cancelled or returned. sales@lambs-stamford.co.ukPack the item securely using the packaging materials it was supplied in, enclosing the delivery note and making sure the outer is labelled clearly and correctly. Return to us so that we receive it within 7 working days after the date that it was delivered to you. 8.3 We recommend that you use a recorded-delivery service so the parcel can be traced if it goes missing, we will not be liable to refund the value of goods if they are not delivered to us or are delivered damaged in any way other than advised in the cancellation email (a claim can be made against the carrier as long as a suitable method of return has been used). Please note that you will be responsible for the costs of returning the item to us, unless we sent it to you in error or we deem the goods to be faulty. 8.4 Please be aware that when we have started the delivery process you will not be able to cancel any contract with us for services relating to that order (e.g. gift wrapping). 8.5 A refund for the relevant part of the purchase will be made as soon as we receive cancellation of your order or upon return of the goods. |
